TERMS AND CONDITIONS

By using and placing an order on The Baked Good (thebakedgood.co, “our site,” “company,” or “we”), you express your understanding and agreement to the Terms below. Please read them, in addition to our Privacy Policy, carefully before using our site. These Terms may change at any time. We will post the most updated version on our site with a new Effective Date. Changes will be implemented from this Effective Date.

AGE REQUIREMENT

You must be at least 18 years old to place an order on our site. If you are younger than 18, we ask that you to let a parent or legal guardian place your order. If it comes to our attention that an order has been made by a person under the age of 18, we reserve the right to decline service.

1. PRODUCTS

Products may vary slightly from the images on our site. While we have made every effort to represent the products and details as accurately as possible, the actual products may have slight color, texture, and shape variations.

Some products may also contain certain ingredients that are common allergens, or require a specific production period (we like our baked goods fresh!) to guarantee you the best possible product. Please take the time to read through all the details on the product page.

2. ORDER PROCESS

After completing checkout, you will be redirected to a page confirming your order details. (For customers paying through Paypal, credit card, bank deposit, or Bitcoin, full payment is required before your order can be confirmed. Payment instructions will be given during the checkout process.) You will also receive a confirmation email sent to the address on your checkout form. If you do not receive anything within 24 hours, or if there is any incorrect information, please contact us at [email protected]

If we are unable to fulfill your order for any reason, we will contact you as soon as possible work towards amending your order.

3. PAYMENT

We gladly accept Paypal, all major payment cards (through the Paypal payment gateway), and bank transfer. Our site currently uses third-party payment processors; your purchase of any Products will be subject to the terms and conditions of the applicable payment processor. Orders are charged in Philippine Pesos or the equivalent.

4. DELIVERY

We currently deliver to and from areas within Metro Manila. When you place an order, the delivery details will be included in the confirmation email we send to you. You will receive another email when the product has been shipped to you. Delivery will be completed when the Product arrives at the address you have provided us. We are not responsible should you enter any incorrect or inaccurate destination data in your order.

We recommend that all products be secured immediately upon delivery. You are responsible for arranging for an individual to be present at the time of delivery to properly receive and secure the product. Any individual at the delivery address who accepts the product is conclusively presumed to be authorized to receive the delivery. If no one is present at the designated delivery address, it is at the discretion of the courier to determine if your product may be safely left at the designated delivery address.

The exact time of delivery is subject to the courier. If you are placing an order for a time-sensitive event (special occasions, gatherings, etc.), we recommend scheduling the delivery date a day earlier. Many of our goods can be frozen or refrigerated upon arrival to preserve freshness.

5. YOUR INFORMATION

We will need to collect your customer information to deliver and complete your order, and when you register for an Account. This typically includes name, address, contact number, and payment details. By providing this information, you grant us and our third party processors the right to use it for payment, delivery fulfilment, and customer service.

We take your privacy seriously. All your information is kept secure and will not be shared to third parties without your knowledge. We do not store any payment card details; all payments are processed through reputable payment gateways, and use secure SSL technology to keep your information safe. In exchange, we ask that all information you provide us is current, complete, accurate, and belongs to you. We are not responsible for any loss or damage arising from the submission of false or inaccurate information.

6. REPLACEMENTS OR REFUNDS

As our site sells food products that are perishable and require advance preparation, we are unable to accept returns or exchanges once an order has been accepted. We are committed to providing the best service we can; if you are unhappy with a product, please contact us at [email protected].

It is important to us that we work with parties that put special care in packaging and protecting your products during transit. In the unlikely event a product reaches you incomplete, damaged, or spoiled upon arrival, we will do all we can to amend the situation (either by replacing or refunding your order).

We request that you contact us at [email protected] immediately (within 5 days of the product delivery date), providing photos and details as to why the product is unsatisfactory. Once your request has been received and we have verified that your product was in an unacceptable condition when delivered, you will be entitled to the option of same product replacement or full refund. If there are indications that the product was delivered in good condition, we will communicate with you to find the best resolution for all parties involved. Please allow us sufficient time to remedy the situation and respond. We are committed to providing the best service we can.

7. SITE CONTENT

Our site, its components, and all material on it are owned by our company or third party providers. Nothing in these Terms transfers any title or grant any license to you. Site content, such as images and material, may be used as is if properly credited (For example, a byline may read: “Cookies by Baker, found on TheBakedGood.co”). We reserve the right to request any of our site content used by third parties be removed.

8. USER CONDUCT

All submissions to public areas on our site (i.e., reviews, comments) are intended for public view and may be credited to your submitted user name. Users retain ownership of their submissions; we are not responsible for the actions made by any other site users. Should you feel an action is made in violation to you and your rights, please contact us at [email protected] and we will do all we can to come to an immediate resolution.

While using our site, you may not:

  • defame, offend, abuse, harass, threaten, or otherwise violate the rights of others, including company representatives or other users;
  • post or upload any content that contains viruses or any other computer code or files that may disrupt or damage the proper function of any software or hardware;
  • post or upload any content that you have not obtained the rights or permissions to use, including impersonating any individual or entity;
  • post or upload any unauthorized or unsolicited advertising, surveys, contests, or commercial content; or
  • alter or translate the site and its contents for unauthorized commercial use.

Users with an account are responsible for all activity that occurs under that account. We advise that each user registers only one account, of which they keep private and retain sole access.

9. WARRANTIES AND LIABILITY

Our site and materials published on it are provided “as is” and “as available.” We are not liable or do not make warranties of any kind concerning the accuracy, likely results, or reliability of the use or the inability to of our site or the the materials on our site. Please use our site and services at your own discretion. We do not guarantee our site or any third party will be accessible at all times or locations, that services will be uninterrupted or error-free, that errors will be corrected, that data transmission or storage is secure, or that services are free of inaccuracies, misrepresentations, viruses,  harmful information or components, or that the services will meet your requirements.

Our site may contain links to other websites. These are provided for informational purposes only. We do not endorse or guarantee any website or service by providing these links.

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless our company, our representatives, affiliates, and all associated third parties against any and all claims, losses, expenses, or demands of liability, including attorneys' fees and costs incurred arising out of or in any relation to the use of our site and services.

Each of the paragraphs in these Terms operates separately. If any one of them are unlawful or unenforceable in a particular jurisdiction, the remaining paragraphs will remain in effect.
